Hargraves Secured Investments v Waller [2009] NSWSC 1210
On 12 November 2009 Judge Harrison delivered judgment in this case.
The case examined the Farm Debt Mediation Act and whether or not, in circumstances where there is a new loan, a further mediation should occur. It also examined whether or not one of the loans granted to Mrs Waller was unjust. The Court decided against Mrs Waller in both cases.

The LGT Venture Philanthropy Foundation was founded in 2007 by initiative and funds of the Princely Family of Liechtenstein. Its mission is to raise the sustainable quality of life for the less advantaged people especially in the developing world. Applying a venture philanthropy approach, LGT Venture Philanthropy supports both organizations with financial, social and intellectual capital. LGT Venture Philanthropy makes use of grants, loans and equity investments. Any generated profit is channeled back into the fund and will be used for additional investments.
LGT Venture Philanthropy is pleased to share some results of its philanthropic activities with you: The portfolio has grown to seven organizations with USD 3 Mio invested, the global team now counts 12 people in seven countries, negotiations with several clients interested in LGT Venture Philanthropy's due diligence and investment services are ongoing, and last but not least, the feedback about the 1st generation of fellows in LGT Venture Philanthropy's fellowship program has been overwhelmingly positive!
Summary iCats Program
LGT Venture Philanthropy is proud to announce the launch of the iCats Program: The iCats Program is an answer to the need for professional know-how and resources in many philanthropic organizations and social enterprises. LGT Venture Philanthropy created a web-based platform to match experienced professionals with specific positions in selected philanthropic organizations.
The fellow positions for 2010 are now online on www.icatsprogram.com ! Application deadline is 26th October 2009.
A fellow works 11 months on-site with a portfolio organization from February to December 2010 and receives regular mentoring from the LGT Venture Philanthropy team. New artwork by PLOY and DEKA
Jackson Lalic commissioned street artists PLOY and DEKA to paint two of the office doors and the connecting panel as one street art work. An image of the work appears on the Jackson Lalic website as part of the art collection. Anyone wishing to have a more careful look at the work is welcome to view it when next at the offices of Jackson Lalic.

Jackson Lalic welcomes Andreas Bietmann
On 1 February 2009 Andreas Bietmann commenced his 3 month internship at Jackson Lalic. Andreas is the latest in a long line of German students who have chosen to complete their legal education by spending time in Australia under the mentorship of Peter Jackson.

JACKSON LALIC ACT FOR MR PHUONG NGO AT AN ENQUIRY INTO HIS CONVICTION FOR THE MURDER OF MR JOHN NEWMAN.
Mr Justice Patten was appointed by the Chief Judge of New South Wales to enquire into the conviction of Mr Phuong Ngo for the murder of Mr John Newman in 1994. Mr Ngo has been in prison for 10 years.
Mr Ngo will be the first witness at the enquiry and will commence his evidence on 8 October 2008.
Mr Peter Hastings QC leading Miss Rachel Pepper has been briefed by Jackson Lalic. Mr Faris Shehabi is attending to the many day to day aspects of representing Mr Ngo.

Jackson Smith has joined the newly formed Water Law Association – an initiative of Tamworth solicitor Michael McHugh. The first object of the Association is to enhance the practice of water law and the administration of water rights in the State of new South Wales in particular and Australia generally.

Important Bore Licence Decision Delivered
On 4 November 2004 Judge Levine of the Supreme Court of New South Wales handed down the decision in Jones v The Water Administration Ministerial Corporation. This decision requires the department to issue to Mr Jones a water licence in circumstances where Mr Jones had properly completed an application and paid the prescribed fee. The department had placed an embargo on the issue of licences in the context of a review of water policy in New South Wales. Anyone who wishes to receive a copy of the judgment, please contact this office.

Early discovery of documents ordered by Supreme Court
On 13 May 2004 the Murray Darling Basin Commission lost an appeal in respect of summary dismissal application in an action that had been brought by Collendina Pty Ltd. Collendina was also successful in obtaining an order for early discovery of documents that were in the possession of the Commission. The claim relates to damage caused to the Collendina property following release of water from the Hume dam in 1996.
Water Sharing Plan declared valid.
On 7 April 2004 the Land & Environment Court dismissed an application that the Water Sharing Plan for the lower Murrumbidgee ground water sources was invalid. The Court granted leave to the applicant, the Murrumbidgee Ground Water Preservation Association, to file a further amended application.
